Can the stepdaughter inherit from the stepmother?

Question:

I just had a query in regards to the distribution of residuary estate for a client who wants his Islamic Wil prepared by us.

 

A brief background of the client is that:

  •  he is divorced;
  • He has a daughter from his previous marriage;
  • He has 2 sons with his new wife;

 

The question is from Shariah principles point of view - whether his daughter from his previous marriage can have a portion of his current wife’s residuary estate as well?

Your query refers.

In principle, the daughter of the ex-wife does not inherit from the current wife as step children do not inherit from the step mother as there is no direct link of Asabiyyah or Fardiyyah.

The daughter will however inherit from the father although from a previous marriage.
