SEFA Government Grant/Loan: Shariah Compliant?

Assalamu Alykum Mufti Ismail Desai,

I run a major manufacturing concern in South Africa and have applied for a SEFA Government Grant/Loan.

Am I allowed to take out such a loan? Please find the attached terms of the loan and grant agreement.

Your question refers.

We understand that SEFA is a Government Agency that will provide you with a 60 month loan with a 5% interest rate and a grace period of 12 months. The same agency will also provide you with a grant as a 60% non-payable grant.

In principle, a loan with interest is impermissible. Moreover one cannot intentionally execute a usurious transaction and offset the interest charges with the capital. Therefore the current agreement is not permitted due to the explicit reference to interest charges.

However, you can avail the facility with the firm intention of repaying the principle only within 12 months based on genuine need (Haajah) and based on our understanding of the loan schedule on page 5 which clarifies that the capital and interest are explicitly waived for the first twelve months.

Ideally, you should offer SEFA to develop a Shariah compliant Murabaha concept where SEFA will purchase the goods by settling your invoices and selling the goods to you for a fixed mark up in a Shariah compliant manner. We have structured a number of such solutions and will be available to assist if required.
